Compensation for dismissal without cause or for a disputed cause.
When the employer decides to terminate the employment relationship without a justified reason, the worker is entitled to compensation.
In general, this compensation is comprised of three main concepts:
1. Seniority Compensation:
It corresponds to one month's salary for each year worked or fraction greater than three months.
It is the central component of dismissal without cause.
2. Notice:
If the employer does not give advance notice of the termination, they must pay the notice period.
The term varies depending on the time worked.
The salary is paid equivalent to the omitted notice period.
3. Integration of the Dismissal Month:
If the dismissal occurs during the month and there are days remaining until the end of the month, the salary is paid proportionally to those days.
Final Settlement:
In addition to severance pay, the employee receives a final settlement, which includes:
1. Unused vacation days
Proportional payment for the vacation days that were due but not taken.
2. Proportional SAC (bonus)
The proportional amount of the Christmas bonus corresponding to the semester in which the dismissal occurred is paid.
3. Outstanding wages
Any wages for the month worked that have not yet been paid
